Mars loses chocolate suit

The maker of Mars Bars, Bounty, M&M’s and Snickers, has lost a bid to hold trademark rights over the shape of its Bounty coconut/chocolate products.

After a six-year fight by the US based Mars company, the European Court of First Instance found in favour of German competitor Ludwig Schokolade.

The court found the Bounty product was devoid of any distinctive character.

Mars had appealed a decision by the EU's trademark agency.
